The agreement <br />provides protection for the City’s improvements to the Right of Way and guarantees insurance <br />coverage in the event of any incidental damage. There is no fee associated with the agreement. It <br />is required as a condition to the project permit. <br /> <br />Project summary statement: <br />Pacific Rucker, LLC has requested a permit for use of a portion of the public right of way during <br />construction of a mixed use, multi-family apartment building consisting of approximately 214 <br />units. Pacific Rucker, LLC has submitted plans for a project to construct a mixed use commercial <br />and multi-family apartment building with approximately 214 units. During construction, <br />excavation will require shoring walls for support of below-grade development. The shoring walls <br />must be secured by tie-backs that extend into the right-of-way. Once the project is completed, <br />the tie-backs will no longer be needed and will be removed. The proposed Temporary Right of <br />Way Use Permit and Agreement sets forth agreed terms between the City and Pacific Rucker, <br />LLC. <br /> <br />Recommendation (exact action requested of Council): <br />Authorize the Mayor to execute the temporary Right of Way use permit and agreement with <br />Pacific Rucker, LLC. <br />
