1 <br /> <br /> <br />AMENDMENT TO CONTRACT <br />FOR AGREED CONTRACT TERMINATION <br /> <br />This Amendment to Contract for Agreed Contract Termination (“Agreement”) is effective <br />as of the date of the last signature below, and is between the City of Everett, a Washington <br />municipal corporation (the “City”), and the Contractor identified below (“Contractor”). The City <br />and Contractor are parties to the Contract described below, as may have been previously <br />amended ("Contract"). In consideration of the covenants, terms and conditions set forth below, <br />and for good and valuable consideration, the receipt and sufficiency of which are hereby <br />acknowledged, the City and Contractor agree to terminate the Contract under the terms and <br />conditions set forth below: <br />Contractor Boadus Pride LLC <br />Contract Name 2024-162 Thornton A Sullivan Park Float Renovation <br />Project Repairs to three existing floats at Thorton A. The Contract is terminated. <br />B. The City will make no payments to Contractor of any kind arising <br />from or relating to the Contract. <br />C. The City will not seek damages from Contractor for Contractor’s <br />failure to perform under the Contract. <br />D. The City releases the Surety from its obligations to the City under <br />the Project Performance and Payment Bonds. <br />E. This agreed termination may be considered by the City in <br />considering future bids from Contractor for City work. <br />This Amendment may be signed in counterparts.
