Except as provided in Section 10.74.065, a person who intentionally furnishes a keg or <br /> other container containing four or more gallons of malt liquor to a person under the age of <br /> twenty-one years is guilty of a gross misdemeanor. <br /> B. The violation of any provisions of this chapter is a gross misdemeanor. <br /> Section 2: Section 112 of Ordinance 1145-85 (Everett Municipal Code 10.42.020), which <br /> reads as follows: <br /> Opening or consuming in public place -Penalty. <br /> Except as permitted by RCW Title 66 or ordinances of the city, no person shall open a package <br /> containing liquor or consume liquor in a public place. Any person who violates this section shall <br /> be guilty of a misdemeanor, and on conviction therefor shall be fined not more than one hundred <br /> dollars. <br /> is hereby amended to read as follows: <br /> Opening or consuming in public place -Penalty. <br /> Except as permitted by RCW Title 66 or ordinances of the city, no person shall open the package <br /> containing liquor or consume liquor in a public place. Violation of any of the provisions of this <br /> section is an infraction, and may be punished by a fine of fifty dollars, not including statutory <br /> assessments. <br /> Section 3: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its <br /> application to any person or situation be declared unconstitutional or invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this ordinance or its application <br /> to any other person or situation. The City Council of the City of Everett hereby declares that it <br /> would have adopted this ordinance and each section, subsection, sentence, clause, phrase or <br /> portion thereof irrespective of the fact that any one or more sections, subsections, clauses, <br /> phrases or portions be declared invalid or unconstitutional. <br /> Section 4: Third Party Liability <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety and <br /> welfare of the general public and not to create or otherwise establish or designate any particular <br /> class or group of persons who will or should be especially protected or benefited by the terms of <br /> this ordinance.
