2025 FEDERAL OVERLAY, W MUKILTEO BLVD – GLENWOOD AVE TO DOGWOOD DR <br /> PAGE SP23 OF SP123 SPECIAL PROVISIONS <br />WORK ORDER #3842 April 15, 2025 FEDERAL AID# NHPP-2776(011) <br />A certification of materials origin will be required for all iron or steel products prior to such 1 <br />items being incorporated into the permanent work. The Contractor will not receive 2 <br />payment until the certification is received by the Engineer. The certification shall be on 3 <br />WSDOT Form 350-109 provided by the Engineer, or such other form the Contractor 4 <br />chooses, provided it contains the same information as WSDOT Form 350-109. 5 <br /> 6 <br />Manufactured Products 7 <br />Due to a nationwide waiver, Buy America requirements do not apply to Manufactured 8 <br />Products except as follows: 9 <br /> 10 <br />1. When a precast concrete product is classified as a Manufactured Product, the 11 <br />components that are an Iron or Steel Product shall follow the “Iron and Steel 12 <br />Requirements” of this Specification. 13 <br /> 14 <br />2. When an electronic hardware system such as an intelligent transportation 15 <br />system is classified as a Manufactured Product, the cabinets and the other 16 <br />enclosures of such systems that are an Iron or Steel Product shall follow the 17 <br />“Iron and Steel Requirements” of this Specification. 18 <br /> 19 <br />Construction Material Requirements 20 <br />A Contractor provided certification of materials origin will be required before each 21 <br />progress estimate or payment. The Contractor will not receive payment until the 22 <br />certification is received by the Engineer. The Contractor shall certify that all Construction 23 <br />Materials installed during the current progress estimate period meet the Buy America 24 <br />requirements. The certification shall be on WSDOT Form 350-111 provided by the 25 <br />Engineer, or such other form the Contractor chooses, provided it contains the same 26 <br />information as WSDOT Form 350-111. 27 <br /> 28 <br />Waiver for De Minimis Costs 29 <br />Minor amounts of Foreign Construction Materials may be utilized in this project, provided 30 <br />that the total cost of the Foreign Construction Materials does not exceed $1,000,000 and 31 <br />does not exceed 5 percent of the total applicable material costs calculated as follows: 32 <br /> 33 <br /> <br /> < 0.05 34 <br /> 35 <br />The total applicable material costs shall be the sum of the costs all Construction Materials, 36 <br />all Iron or Steel Products, and all Manufactured Products.
