Making efforts to assist interested DBEs in obtaining necessary equipment, 2 <br />supplies, materials, or related assistance or services. 3 <br /> 4 <br />7. Effectively using the services of available minority/women community 5 <br />organizations; minority/women contractors’ groups; local, State, and Federal 6 <br />minority/women business assistance offices; and other organizations as allowed 7 <br />on a case-by-case basis to provide assistance in the recruitment and placement 8 <br />of DBEs. 9 <br /> 10 <br />8. GFE Documentation must include copies of each DBE and non-DBE 11 <br />subcontractor quotes submitted to the Bidder when a non-DBE subcontractor is 12 <br />selected over a DBE for Work on the Contract. (ref. updated DBE regulations – 13 <br />26.53(b)(2)(vi) & App. A) 14 <br /> 15 <br />Administrative Reconsideration of GFE Documentation 16 <br />A Bidder has the right to request reconsideration if the GFE Documentation submitted 17 <br />with their Bid was determined to be inadequate or without merit. If, during the life of 18 <br />the Contract, the Contractor submits an additional GFE Documentation and the 19 <br />Contracting Agency’s GFE Documentation review determines a GFE Documentation 20 <br />is inadequate or has no merit, the Contractor has the right to request reconsideration 21 <br />of the Contracting Agency’s determination. 22 <br /> 23 <br />1. The Bidder must request reconsideration within 48 hours of notification of 24 <br />GFE Documentation being inadequate or without merit, or the Bidder 25 <br />forfeits the right to reconsideration. 26 <br /> 27 <br />2 The reconsideration decision on the adequacy or merit of the Bidder’s GFE 28 <br />Documentation shall be made by an official who did not take part in the 29 <br />original determination. 30 <br /> 31 <br />3 Only original GFE Documentation submitted as a supplement to the Bid will 32 <br />be considered. The Bidder shall not introduce new documentation at the 33 <br />reconsideration hearing. 34 <br /> 35 <br />4 The Bidder shall have the opportunity to meet in person with the official for 36 <br />the purpose of setting forth the Bidder’s position as to why the GFE 37 <br />Documentation demonstrates a sufficient effort. 38 <br /> 39 <br />•5 The reconsideration official shall provide the Bidder with a written decision 40 <br />on reconsideration within five working days of the hearing explaining the 41 <br />basis for their finding. 42 <br /> 43 <br />Consequences of Non-Compliance 44 <br />Breach of Contract 45 <br />Each contract with a Contractor (and each subcontract the Contractor signs with a 46 <br />subcontractor) must include the following assurance clause: 47 <br /> 48 <br />The Contractor, subrecipient, or subcontractor shall not discriminate on the basis of 49 <br />race, color, national origin, or sex in the performance of this contract.
