1 <br />1 <br />Section XVI of this Decree, for such period of time as Ecology determines is reasonable under <br />2 <br />the circumstances. Any disagreements pursuant to the clause shall be resolved through the <br />3 <br />dispute resolution procedures in Section XIV. <br />4 <br />XVIII. INDEMNIFICATION <br />5 <br />The City of Everett agrees to indemnify and save and hold the State of Washington, its <br />6 <br />employees, and agents harmless from any and all claims or causes of action for death or <br />7 <br />injuries to persons, or loss or damage to property arising from or on account of acts or <br />8 <br />omissions of the City of Everett, its officers, employees, agents, or contractors in entering into <br />9 <br />and implementing this Decree. However, the City of Everett shall not indemnify the State of <br />10 <br />Washington nor save nor hold its employees and agents harmless from any claims or causes of <br />11 <br />action arising out of the negligent acts or omissions of the State of Washington, or the <br />12 <br />employees or agents of the State, in implementing the activities pursuant to this Decree. <br />13 <br />XIX. DISCLAIMER <br />14 <br />This Decree does not constitute a representation by the State of Washington that the <br />15 <br />Site is fit for any particular purpose. <br />16 <br />XX. COMPLIANCE WITH APPLICABLE LAWS <br />17 <br />A. All actions carried out by the City of Everett pursuant to this Decree shall be <br />18 <br />done in accordance with all applicable federal, state, and local requirements, including <br />19 <br />requirements to obtain necessary permits, except as provided in paragraph B of this Section. <br />20 <br />B.
