1 <br />The City of Everett <br />The Floyd & Snider Team Everett Landfill/Tire Fire Site <br />REGULATIONS RELATING TO MINIMUM FUNCTIONAL STANDARDS FOR SOLID WASTE HANDLING, <br />CHAPTER 70.95 RCW; CHAPTER 173-301 WAC <br />The regulations in Chapter 173-301 WAC, that were developed pursuant to Chapter 70.95 <br />RCW, set minimum functional standards for the proper handling of all solid waste originating <br />from residences, commercial, agricultural and industrial operations and other sources to prevent <br />pollution, breeding of flies, harboring of rodents, fire hazards and damage to recreational values, <br />conserve resources, and maintain esthetic values. These regulations provided guidance on <br />solid waste storage, collection and transportation, transfer stations, establishment and operation <br />of a solid waste site, incinerators, sludge management, leachate control, final cover installation, <br />and post -closure maintenance. These regulations have since been replaced with Minimum <br />Functional Standards (Chapter 173-304 WAC). The Everett Landfill was closed in 1976 under <br />Chapter 173-301 WAC. <br />MINIMUM FUNCTIONAL STANDARDS FOR SOLID WASTE HANDLING, CHAPTER 173-304 WAC <br />This regulation is promulgated under the authority of Chapter 70.95 RCW to protect public <br />health, to prevent land, air, and water pollution, and conserve the state's natural, economic, and <br />energy resources by: <br />• Setting minimum functional performance standards for the proper handling of all solid <br />waste materials originating from residences, commercial, agricultural and industrial <br />operations and other sources. <br />• Identifying those functions necessary to assure effective solid waste handling <br />programs at both the state and local level. <br />• Following the direction set by the legislature for the management of solid waste in <br />order of descending priority as applicable: <br />a) Waste reduction <br />b) Waste recycling <br />c) Energy recovery or incineration <br />d) Landfill <br />• Describing the responsibility of persons, municipalities, regional agencies, and state <br />and local government under existing laws and regulations related to solid waste. <br />• Requiring use of the best available technology for siting, and all known available and <br />reasonable methods for designing, constructing, operating, and closing solid waste <br />handling facilities. <br />• Establishing these standards as minimum standards for solid waste handling to <br />provide a statewide consistency and expectation as to the level at which solid waste <br />is managed throughout the state. <br />This regulation was adopted in October 1985 to replace Chapter 173-301 WAC. However, the <br />Everett Landfill was closed under Chapter 173-301 WAC [Regulations Relating to Minimum <br />Page 2 of 10 Attachment CAP-1 <br />
