1 <br />�J <br />1 <br />1 <br />1 <br />1 <br />1 <br />1 <br />li <br />1 <br />The City of Everett <br />The Floyd & Snider Team Everett Landfill/Tire Fire Site <br />permits for the discharge of dredged or fill material to navigable waters, including jurisdictional <br />wetlands. <br />Discharges of material into navigable waters are regulated under Sections 401 and 404 of the <br />CWA (33 USC 1341 and 1344), 40 CFR 230 (Section 404(b)(1) guidelines), 33 CFR 320 <br />(general policies), 323 and 325 (permit requirements) and 328 (definition of waters of the United <br />States). <br />The U.S. Army Corps of Engineers issues or denies permits. Actions may either be subject to: <br />1) an individual permit; 2) covered under the provisions of a general permit; or 3) exempt from <br />regulatory requirements. <br />Proposed cleanup actions associated with the Everett Landfill CAP/CD would not alter wetlands <br />or discharge dredged or fill material to navigable waters. <br />FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) <br />A portion of the landfill site is designated by FEMA as Snohomish River Floodplain. However, <br />this designation needs to be updated and clarified, consistent with current site topography. <br />Proposed cleanup actions associated with the Everett Landfill CAP/CD are not expected to alter <br />surface elevations, or create obstruction within the mapped floodplain. <br />WATER QUALITY STANDARDS FOR THE SURFACE WATERS OF THE STATE OF WASHINGTON, <br />CHAPTER 90.48 RCW; CHAPTER 173-201A WAC <br />These regulations establish water quality standards for the surface waters of the state as <br />required by the Clean Water Act and the Water Pollution Control Act (Chapter 90.48 RCW). <br />Specific standards apply for many toxic substances. These surface water quality standards <br />have been used to establish cleanup levels for the groundwater pathway. <br />WATER QUALITY STANDARDS FOR GROUNDWATERS OF THE STATE, CHAPTERS 90.48 AND <br />90.54 RCW; CHAPTER 173-200 <br />The regulations in Chapter 173-200 WAC, which were developed pursuant to Chapters 90.48 <br />and 90.54 RCW, establish groundwater quality standards that, together with the state's <br />technology -based treatment requirements, provide for the protection of the environment and <br />human health and protection of existing and future beneficial uses of groundwater. These <br />groundwater quality standards are potential ARARs for groundwater quality. <br />GROUP A PUBLIC WATER SYSTEMS, CHAPTER 246-290 WAC <br />Section 310 identifies maximum contaminant levels (MCLs) for public drinking water supplies in <br />Washington State.
