Dwelling units satfsfying the affordability requirements of this 1 <br />sectfon may also satfsfy the affordable housing requirements of Chapter 3.78 EMC. 2 <br />19.09.100, MODIFICATION OF DEVELOPMENT STANDARDS. 3 <br />An applicant may propose and the planning director, using the review process described in EMC Title 15, 4 <br />Local Project Review Procedures, may allow an applicant to deviate from certain development standards 5 <br />of this chapter, as provided herein, provided the proposal satfsfies the evaluatfon criteria of this sectfon. 6 <br />In evaluatfng such a proposal, the planning director shall determine if the alternatfve design provides 7 <br />equivalent or superior results to that which would be required by compliance with the development 8 <br />standards of this chapter. 9 <br />A. What Can Be Modified. The following standards can be modified: 10 <br />1. Building modulatfon. 11 <br />2. Facades (dwelling and garage). 12 <br />3. Building entrance requirements. 13 <br />4. Required outdoor and common area. 14 <br />B. Evaluatfon Criteria for Modificatfon. See Chapter 15.03 EMC. 15 <br />C. Appeal of Planning Director’s Decision. An appeal of the planning director’s decision using this 16 <br />process shall be reviewed by the hearing examiner in accordance with EMC Title 15, Local Project Review 17 <br />Procedures. Substantfal weight shall be given to the decision of the planning director in considering any 18 <br />appeal. 19 <br />19.09.120, DESIGN REVIEW. 20 <br />The planning director may engage the services of a licensed architect, or other licensed design 21 <br />professional when the director deems it appropriate and in the public interest, to provide 22 <br />recommendatfons in connectfon with the review of any project that: 23 <br />A. Is subject to any design standard or guideline established in this chapter; or 24 <br />B. Involves discretfonary design-related decisions, such as a modificatfon of design standards, 25 <br />authorized in this chapter; or 26 <br />C. Involves design-related decisions to implement building form and design standards set forth in EMC 27 <br />19.09.020. 28 <br />Recommendatfons of the architect or design professional shall be advisory only and shall not otherwise 29 <br />limit the director’s authority to require changes in any project design to meet the design requirements of 30 <br />this tftle or the director’s discretfon to approve or deny requested modificatfons or apply discretfonary 31 <br />design criteria. 32
