When notfce of applicatfon is required in EMC Title 15, the city shall provide notfce of applicatfons 5 <br />for development actfvitfes or uses within an ACA to the airport manager of Paine Field. 6 <br />B. Applicants for development within an ACA are encouraged to work cooperatfvely with the airport 7 <br />manager and refer to FAA and Washington State Department of Transportatfon guidance related to 8 <br />airport and land use compatfbility. 9 <br />C. Development approvals and building permits for development actfvity and uses subject to EMC 10 <br />19.17.070(B)(4) shall not be issued untfl the owner of the property with the proposed development 11 <br />actfvity or use signs and records with the county auditor a disclosure notfce that: 12 <br />1. Is in a form provided by the department; 13 <br />2. Contains a legal descriptfon of the property; 14 <br />3. Bears a notarized signature of the owner; and 15 <br />4. Contains the disclosure text set forth in EMC 19.17.090. 16 <br />This subsectfon does not apply when the disclosure text already has been recorded against the property. 17 <br />D. In no case shall liability attach to the city for any actfons, error, or omissions of any person subject to 18 <br />the requirements of this sectfon. 19 <br />19.17.090 DISCLOSURE TEXT FOR AIRPORT INFLUENCE AREA. 20 <br />The following shall constftute the airport influence area disclosure required by EMC 19.17.080: 21 <br />Your real property is located within the Airport Influence Area of Paine Field. Occupants of propertfes 22 <br />within the Airport Influence Area may be subject to inconveniences or discomforts arising from aviatfon 23 <br />actfvitfes, including but not limited to noise, odors, fumes, dust, smoke, hours of operatfon, low 24 <br />overhead flights and other aeronautfcal actfvitfes. Everett Municipal Code (EMC) 19.17.080 requires that 25 <br />you receive this disclosure notfce in connectfon with permits you are or may be seeking. A provision of 26 <br />EMC 20.08.100 provides that “Noise originatfng from aircraft in flight and sounds which originate at 27 <br />airports and are directly related to flight operatfons” is exempt from noise control regulatfons. The City 28 <br />of Everett has adopted airport compatfbility regulatfons in Chapter 19.17 EMC which may affect you and 29 <br />your land. You may obtain a copy of Chapter 19.17 EMC from the City of Everett. In additfon, current and 30 <br />future property owners are notffied that the Federal Aviatfon Administratfon establishes standards and 31 <br />notfficatfon requirements for potentfal height hazards that may be caused by structures, buildings, trees 32 <br />and other objects affectfng navigable air space through 14 Code of Federal Regulatfons Federal Aviatfon 33 <br />Regulatfons Part 77. This disclosure may no longer be applicable if the subject property is removed from 34 <br />the Airport Influence Area. 35
