EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 46 <br />19.04.100, USE DEFINITIONS, OTHER 1 <br />“Aircraft landing facilitfes” means airports, landing fields, helipads, or seaplane landing facilitfes and 2 <br />terminals for the accommodatfon of passengers and/or cargo carried by means of air transport. 3 <br />“Bus Rapid Transit” means a public transit route that includes a combinatfon of statfon facilitfes and 4 <br />improvements to the right-of-way that provide for enhanced frequently, reliability, and speed, including 5 <br />off-board fare payment and all-door boarding and dedicated transit or high-occupancy vehicle lanes 6 <br />along all or part of the route. 7 <br />“Home occupatfon” means an occupatfon which is incidental and subordinate to a residentfal use, which 8 <br />is carried on by a member of the family residing in the dwelling. 9 <br />“Junk store” means a retail store that sells previously used merchandise or goods the majority of which: 10 <br />1. Have not been maintained, repaired, restored or reconditfoned to a functfonal conditfon; or 11 <br />2. Consist of salvaged or disassembled parts of merchandise, equipment or objects no longer in 12 <br />their original assembled configuratfon. 13 <br />This definitfon excludes secondhand stores, pawnshops, thrift stores and artwork made from recycled or 14 <br />previously used materials incorporated into artwork. The planning director is authorized to maintain a 15 <br />list of stores that qualify as junk stores. 16 <br />“Pawnshop” means an establishment that engages, in whole or in part, in the business of loaning money 17 <br />on the security of pledges of personal property, or deposits or conditfonal sales of personal property, or 18 <br />the purchase or sale of personal property. 19 <br />“Secondhand store” means retail sales of previously used merchandise, the majority of which is not 20 <br />donated, such as clothing, furniture, appliances, household goods, sportfng goods, recreatfonal 21 <br />equipment or other merchandise not considered to be antfque, that is in good repair or has been 22 <br />restored or reconditfoned to a clean and usable conditfon. This definitfon excludes “pawn shop,” “thrift 23 <br />store,” and “junk store.” The planning director is authorized to maintain a list of stores that qualify as 24 <br />secondhand stores. 25 <br />“Specified anatomical areas” means: 26 <br />1. Less than completely and opaquely covered human genitals, pubic region, buttock and 27 <br />female breast below a point immediately above the top of the areola; and 28 <br />2. Human male genitals in a discernible turgid state, even if completely and opaquely covered. 29 <br />“Specified sexual actfvitfes” means: 30 <br />1. Human genitals in a state of sexual stfmulatfon or arousal; 31 <br />2. Acts of human masturbatfon, sexual intercourse or sodomy; 32 <br />3. Fondling or other erotfc touching of human genitals, pubic region, buttock or female breast. 33 <br />“Thrift store” means a store that derives the majority of its sales from donated previously used 34 <br />merchandise such as clothing, furniture, appliances, household goods, sportfng goods, recreatfonal 35
