The use of the flex spaces as a sleeping room will be a violation that the owner of the townhouse could face if <br />used that way. It is true that I can not say that such a use will happen, just as true as the designer/builder stating that <br />the situation will not happen. It falls on the building official to render interpretations and to clarity the application of the <br />code provisions per Section R104.1. As such, I propose the following: <br />1. It should be stated on the plans that the flex spaces are not sleeping rooms. <br />2. The flex spaces should be shown with smoke detectors installed. <br />3. The flex spaces should be shown with carbon monoxide detectors installed. <br />4. A copy of the notification of use that will be part of the purchase and sales agreement. <br />Let me know if you accept this alternative means of compliance. Thank you, Tony <br />
