11 <br />Progressive Design Build General Conditions <br /> <br />Prevailing Wages on file with the public agency in accordance with RCW 39.12.04”. Each invoice <br />shall list sales tax as a separate line item. <br />Retainage shall be held by Owner in accordance with Chapter 60.28 RCW. <br />For projects over $10,000, the Design-Builder must post an approved copy of the Statement of <br />Intent, (listing the labor classification and wages used on the project) at the job site. In the event <br />the Statement of Intent has not been approved by the Department of Labor & Industries before <br />work begins, the complete listing of prevailing wage rates for that Owner may be posted and <br />distributed in lieu of the approved Statement of Intent. <br />The Design-Builder shall, within ten days after it receives a written request, file a certified copy of <br />the payroll records with Owner. <br />Upon completion of work, the Design-Builder and each and every Subcontractor (subject to pay <br />prevailing wage) shall file a sworn "AFFIDAVIT OF WAGES PAID" (L&I Form #F700-007-000) <br />with the Department of Labor and Industries certifying the rate of hourly wages paid each <br />classification of laborers, workers, or mechanics employed upon the work by the Design-Builder <br />or subcontractor which shall be not less than the prevailing rate of wage. Fringe benefits for each <br />job classification to be utilized shall also be included. <br />Upon completion of this contract, Owner must receive from the Design-Builder and each and <br />every Subcontractor (subject to prevailing wage) a copy of the "Affidavit of Wages Paid" approved <br />by the State Department of Labor & Industries. Retainage, or Bond, will be released upon receipt <br />of all necessary documentation (including but not limited to releases from the Department of <br />Labor & Industries, Department of Employment Security and, when applicable, Department of <br />Revenue), the settlement of any liens, and in accordance with Chapter 60.28 of the Revised <br />Code of Washington. <br />Owner is required by RCW 39.12.030 to include a provision stating the required prevailing rate(s) <br />in the solicitation and contract documents. To comply with this requirement, Owner is providing <br />the following applicable prevailing wage rate information: <br />A. State of Washington prevailing wage rates published by the Washington State <br />Department of Labor and Industries (L&I) are obtainable from the L&I website address: <br />https://www.lni.wa.gov/licensing-permits/public-works-projects/prevailing-wage-rates/ <br />B. The effective prevailing wage date is the same date as the Execution Date of the GMP <br />Amendment. <br />A copy of the applicable prevailing wage rates are also available for viewing at Owner’s office <br />located at City of Everett, 2930 Wetmore Ave, Everett, WA and the City will mail a hard copy of <br />the prevailing wage rates upon written request received within seven days of the Proposal <br />Submittal Date. <br /> Upon request, Owner will mail a hard copy of the applicable prevailing wage rates for this Project. <br />2.8 Design-Builder’s Responsibility for Project Safety. <br />2.8.1 Design-Builder recognizes the importance of performing the Work in a safe manner so as <br />to prevent damage, injury or loss to (i) all individuals at the Site, whether working or visiting, (ii) <br />the Work, including materials and equipment incorporated into the Work or stored on-Site or off- <br />Site, and (iii) all other property at the Site or adjacent thereto.
