14 <br />Progressive Design Build General Conditions <br /> <br />2.12 Apprenticeship. <br />2.12.1 Apprentice Utilization. This Contract includes an Apprentice Utilization Requirement. <br />Fifteen percent or more of project Labor Hours shall be performed by Apprentices unless Good <br />Faith Efforts are accepted. Apprentice Utilization will be determined using the Department of <br />Labor and Industries (L&I) online Prevailing Wage Intent & Affidavit (PWIA) system. <br />2.12.2 Electronic Reporting. The Design-Builder shall use the PWIA System to submit the <br />“Apprentice Utilization Plan”. Reporting instructions are available in the application. <br />2.12.3 Apprentice Utilization Plan. The Design-Builder shall submit an “Apprentice Utilization <br />Plan” by filling out the Apprentice Utilization Plan Form (WSDOT Form 424-004 or other form <br />approved by the City) within 30 calendar days of Contract execution, however no later than the <br />preconstruction meeting, demonstrating how and when they intend to achieve the Apprentice <br />Utilization Requirement. The Plan shall be in sufficient detail for the City to track the Design- <br />Builder’s progress in meeting the utilization requirements. An Apprentice Utilization Plan shall be <br />updated and resubmitted as the Work progresses or when requested by the City. <br />If the Design-Builder is unable to demonstrate the ability to meet the Apprentice Utilization <br />Requirement with their initial Apprentice Utilization Plan submission, an effort must be made to <br />find additional registered apprentices to perform on the contract. If after attempts have been <br />made at every tier and every scope, the Design-Builder must submit GFE documentation to the <br />City. The Design-Builder shall actively seek out opportunities to meet the Apprentice Utilization <br />Requirement during the construction Work. <br />2.12.4 Contacts. The Design-Builder may obtain information on State-approved Apprenticeship <br />Training Programs by using the Apprentice Registration and Tracking System (ARTS) <br />https://secure.lni.wa.gov/arts-public/#/program-search or contacting the Department of Labor and <br />Industries directly at: <br />Specialty Compliance and Services Division, Apprenticeship Section, P.O. Box 44530, Olympia, <br />WA 98504-4530 or by phone at (360) 902-5320. <br />2.12.5 Compliance. The Design-Builder is expected to make attempts to employ Apprentices <br />and shall include the requirement in any subcontracts at any tier. In the event that the Design- <br />Builder is unable to achieve the Apprentice Utilization Requirement, the Design-Builder shall <br />submit GFE documentation demonstrating the efforts and attempts they made. Final GFE <br />documentation shall be submitted to the City after Substantial Completion but no later than 30 <br />days after Physical Completion. <br />If the Design-Builder fails to actively attempt to employ Apprentices, submit GFE documentation, <br />or if the Engineer does not approve the GFE, the Design-Builder will be assessed a penalty. The <br />City will provide the Design-Builder with a written notice at Final Acceptance of the project <br />informing the Design-Builder of the failure to comply with the Apprentice Utilization Requirement <br />which will include a calculation of the penalty to be assessed as provided for in the Payment <br />section in this special provision. <br />2.12.6 Good Faith Efforts. The GFE shall document the attempts (efforts) the Design-Builder <br />(and any subcontractor at any tier) made to meet the Apprentice Utilization Requirement. Emails, <br />letters, or other written communications with letterhead, titles, and contact information are <br />required. <br />Documentation must include one or more of the following accepted GFEs: <br />1.
