Agreement No. GRT25029-02 <br />Page 1 of 1 <br />STATE OF WASHINGTON <br />OFFICE OF PUBLIC DEFENSE <br />711 Capitol Way South, Suite 106 <br />PO Box 40957 <br />Olympia, WA 98504-0957 <br /> <br />AMENDMENT 2 <br /> <br />Grant Funding Agreement <br />Between <br />WASHINGTON STATE OFFICE OF PUBLIC DEFENSE <br />AND <br />CITY OF EVERETT <br /> <br />WHEREAS, the WASHINGTON STATE OFFICE OF PUBLIC DEFENSE (OPD) and THE <br />CITY OF EVERETT (THE CITY) have entered into a grant funding agreement to provide <br />reimbursement to the City for the cost of providing defense counsel Consultation and <br />Representation for defendants facing charges or charged with simple possession or public use <br />offenses under RCW 69.50.4011(1)(b) or (c), RCW 69.50.4013, RCW 69.50.4014, or RCW <br />69.41.030(1), or under local ordinances involving allegations of possession or public use of a <br />controlled substance, counterfeit substance, or legend drugs, consistent with Second Engrossed <br />Second Substitute Senate Bill 5536, Chapter 1, sec. 35, sec. 39, Laws of 2023; and <br /> <br />WHEREAS, on April 22, 2025, the City’s grant award was decreased by amendment from the <br />original award of $448,600 to an amended, decreased award of $350,000, in anticipation of non- <br />use; and <br /> <br />WHEREAS, the City now appears to have need of additional grant funding; and <br /> <br />WHEREAS the purpose of this Amendment is to increase the funding award amount; now <br /> <br />THEREFORE, IT IS AGREED, that: <br /> <br />1. The City’s grant award is increased by $25,000, from $350,000 to $375,000. <br /> <br />2. Face Sheet, Sec. 5 is amended as follows: <br /> <br />$350,000.00 $375,000.00 <br /> <br />3. Exhibit A, Sec. 3(a) is amended as follows: <br /> <br />a) The maximum amount Recipient may be reimbursed for authorized expenses shall <br />not exceed $350,000.00 $375,000.00 for the period of this Agreement. <br /> <br />4. The amendment’s effective date is the date of last signature. <br /> <br />5. All other terms and conditions of the original Agreement remain unchanged and in full <br />force and effect. <br />
