ORDINANCE NO. 2440-00 <br /> AN ORDINANCE providing for the vacation of TERRACE DRIVE, between <br /> the limits 41' Street to 42nd Street. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 4715 duly <br /> adopt and fix the 17th day of FEBRUARY at 7:00P.M., as the date of public hearing; and <br /> WHEREAS, the City Council of the City of Everett continued the public hearing until <br /> the 17th day of MARCH at 7:00P.M.; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and determination <br /> of said Resolution has been given by the City Clerk in the manner prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly presented; <br /> and <br /> WHEREAS, the City Council finds that there is substantial public use and benefit to the <br /> City by virtue of the vacation in that the City will receive income, property will be returned to <br /> the tax rolls, the vacated street will be privately maintained and the area will be aesthetically <br /> enhanced by virtue of the development occurring in conjunction with the street vacation; and <br /> WHEREAS, the City Council finds it would not vacate said rights of way could it not <br /> retain easements for utilities in Terrace Drive to be vacated; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said rights <br /> of way resolved to be vacated should be vacated pursuant to the terms and conditions of this <br /> ordinance: <br />
