A. No person shall deposit household or commercial garbage, trash, refuse, waste, debris, <br /> rubbish or organic matter which is brought as such from any private property, in any park <br /> garbage receptacle or upon any park property. <br /> B. No person shall abandon an animal by intentionally, knowingly, recklessly or with criminal <br /> negligence leaving a domesticated animal in a park. <br /> C. Violation of any of the provisions of this section constitutes a misdemeanor, and may be <br /> punished by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment not to <br /> exceed ninety(90) days or by both such fine and imprisonment. <br /> Section 11: Section 4 of Ordinance No. 3471 (EMC 9.06.020), which reads as follows: <br /> Definitions. <br /> The terms herein used, unless clearly contrary to or inconsistent with the context in which used, <br /> shall be construed as follows: <br /> A. "Park board"means the members of the park board of the city; <br /> B. "Park" means and includes all city parks, public squares, park drives, parkways, boulevards, <br /> golf courses, park museums, zoos, bathing beaches, and play and recreation grounds under the <br /> jurisdiction of the park board. <br /> Is hereby amended to read as follows: <br /> Definitions. <br /> The terms herein used, unless clearly contrary to or inconsistent with the context in which used, <br /> shall be construed as follows: <br /> A. "Park commission"means the members of the park commission of the city; <br /> B. "Park" means and includes all city parks, public squares, park drives, parkways, boulevards, <br /> golf courses, park museums, zoos, bathing beaches, and play and recreation grounds under the <br /> jurisdiction of the park commission. <br /> Section 12: Section 1 of Ordinance No. 1615-89 (EMC 9.06.034), which reads as follows: <br /> Director responsibility and authority. <br /> A. It shall be the responsibility of the director of the department of parks and recreation of the <br /> city to enforce all provisions of the city park code Chapter 9.06, including park rules and <br /> regulations adopted by the park board. <br /> B. The director and his/her designees shall be empowered to exercise the authority of peace <br /> officers to the extent necessary to enforce the city park code, which power shall include issuance <br /> of citations. <br /> 6 <br />
