<br /> <br /> <br />ORDINANCE Page 2 of 5 <br /> <br />103.2.2 Code Enforcement Unit Supervisor. The Code Enforcement Unit Supervisor shall be the City <br />Building Official’s designated agent and shall hold, in common with the Building Official, all authorities, <br />powers, and responsibilities under this code. The Code Enforcement Unit Supervisor is both a code official <br />for the purposes of this code and a code enforcement officer for the purposes of Chapter 1.20 EMC. <br />Notwithstanding any language in this code, the Building Official is authorized to enforce the provisions of <br />this code, and the Code Enforcement Unit Supervisor exercises authority and responsibility under the <br />direction of the Building Official. <br />103.2.3 Code Enforcement Officers. Day-to-day implementation, administration, and enforcement of this <br />code shall be by the City’s Code Enforcement Unit under the oversight and direction of the Code <br />Enforcement Unit Supervisor. Individuals hired to serve as the unit’s Code Enforcement Officers shall have <br />the powers delegated to them by the City’s Building Official or Code Enforcement Unit Supervisor. <br />C. Section 105.5 of the IPMC is hereby deleted in its entirety and replaced with the following: <br />All notices and orders issued under this code shall be issued as set forth in Chapter 1.20 EMC. <br />D. Sections 107 and 108 of the IPMC are hereby replaced with the following: <br />SECTION 107 MEANS OF APPEAL <br />107.1 Means of Appeal. Appeals are governed by the provisions of Chapter 1.20 EMC. <br />E. Sections 109.2 through 109.5 of the IPMC are hereby deleted in their entirety. <br />F. Section 111.4 of the IPMC, including Sections 111.4.1 and 111.4.2, is hereby deleted in its <br />entirety. <br />G. Sections 112.5 and 112.6 of the IPMC are hereby deleted in their entirety. <br />H. Section 113.1 of the IPMC is hereby replaced with the following: <br />When, after review of a structure, the code official’s judgment is that the structure is vacant, unsecured, <br />and creating a public nuisance or so deteriorated or dilapidated or has become so out of repair as to be <br />dangerous, unsafe, insanitary, or otherwise unfit for human habitation or occupancy, the code official shall <br />order the owner of the premises upon which the structure is located, or the owner’s authorized agent, as <br />follows: <br />If the code official’s judgment is that it is unreasonable to repair the structure; to demolish and remove <br />such structure; or <br />If the code official’s judgment is that the structure is capable of being made safe by repairs; to repair and <br />make safe and sanitary or to board up and hold for future repair or to demolish and remove at the <br />owner’s option; or <br />If the code official’s judgment is that there has been a cessation of normal construction of any structure <br />for a period of more than two years; to demolish and remove such structure, or board up until future use.
