Charges shall be based upon Tenant's estimated usage and shall be agreed upon by Landlord and <br /> Tenant. <br /> 7B. Landlord shall be responsible for: <br /> 1. All real estate taxes (and leasehold excise taxes), if any.These real estate taxes <br /> (and leasehold excise taxes)shall include all real property tax, personal property tax, <br /> government <br /> assessments such as Local Improvement District assessments and Business Improvement Area <br /> assessments that are levied upon and/or assessed against the Property. <br /> 2. Insurance coverage as required by Exhibit 6 of the Landlord's operating <br /> agreement (copy attached). All other insurance is at the sole discretion and cost of Tenant. <br /> 3. Repairs, restoration or other work with respect to the Premises caused by fire, <br /> windstorm or other insured casualty loss;the cost of correcting defects (latent or otherwise) in <br /> the construction of the Premises, except those conditions (not caused, directly or indirectly, by <br /> construction defects) resulting from wear and tear shall not be deemed defects;and costs of <br /> any capital improvements. <br /> 8. Intentionally Omitted. <br /> 9. CONDITION OF PREMISES. <br /> 9A. It is anticipated that construction of the Premises will be completed,and the Premises will be <br /> ready for occupancy by Tenant, on or before September 1, 2024. In order to be ready for occupancy by <br /> Tenant,the Premises shall be finished with painted walls,floor coverings, all permanent fixtures fully <br /> functional such as toilets,sinks, lighting,fixed cabinets and countertops, etc.Tenant is only responsible <br /> for providing its own non-fixed office furnishings,such as desks, chairs,tables, computers, refrigerator, <br /> range, and microwave.Tenant will also be responsible for any window coverings. Upon Tenant's <br /> occupation of the Premises,Tenant will be deemed to have accepted the Premises as being in good, <br /> sanitary order, condition and repair.Tenant is responsible for all upkeep, repairs, upgrades to Tenant- <br /> finished items, interior painted surfaces, and interior floor coverings in the Premises.Tenant shall upon <br />
