Alteration includes the terms "use" and <br /> "development" as defined in this title, and includes any modification of <br /> the natural environment of critical areas or their buffer including any <br /> clearing, grading, filling and/or excavation. Certain exceptions to the <br /> requirements of this chapter are listed in Section 19.37.050. <br /> Maps of known critical areas are maintained by the city. However, the <br /> presence, ►ocation and boundaries of all critical areas are not known. A <br /> site-specific analysis may be required to determine the presence, <br /> location and classification of critical areas. (Ord. 2909-06 § 1, 2006) <br /> EMC 19.37.030 Applicability. <br /> A. This chapter establishes regulations for the protection of critical <br /> areas that are not otherwise regulated by the Shoreline Management <br /> Act and city of Everett Shoreline Master Program.The provisions of this <br /> chapter apply to all lands, all land uses and development activity, and <br /> all structures or facilities outside of shoreline jurisdiction in the city, <br /> whether or not a permit or authorization is required, and shall apply to <br /> every person, firm, partnership, corporation, group, government <br /> agency, or other entity that owns, leases or administers land within the <br /> city. No person, company, agency, or applicant shall alter a critical area <br /> or buffer except as consistent with the purposes and requirements of <br /> this chapter. Except for Sections 37.050.E and 37.120.C, the provisions <br /> of this chapter shall also apply to development within shoreline <br /> jurisdiction in the marshland subarea. No development permit may be <br /> issued; no subdivision of land may be approved; no clearing, filling, or <br /> grading may occur; nor may any use be established, altered, or <br /> expanded on any lot until approvals required by this chapter have been <br /> granted by the city. <br /> B. In addition to the requirements of this chapter, the applicant shall <br /> obtain all necessary state and federal and other local permits. (Ord. <br /> 3202-10 § 3, 2010: Ord. 3129-09 § 29, 2009: Ord. 2909-06 § 3, 2006) <br /> EMC 19.37.040 Critical area features. <br /> On a►► lots containing or adjoining critical areas, the following features <br /> and their buffers shall not be altered or developed except as otherwise <br /> permitted by this chapter: <br /> *** <br /> B. Wetlands; <br /> *** <br /> D. Fish and wildlife habitat conservation areas, including <br /> streams/riparian areas, lakes and ponds less than twenty acres in size, <br /> habitats of primary association, continuous vegetative corridors linking <br /> watersheds, and significant biological areas listed in Section <br /> Page 3 of 8 <br />
