CITY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT(the"License"), between the City of Everett as Grantor <br /> (the"City) and Redside Construction,LLC.,600 Winslow Way E. Suite#237,Bainbridge <br /> Island, WA 98110„ as the Grantee("Redside"), relates to a hauling sand over a portion <br /> of a 13.13 acres land site owned by the City, located on Snohomish County Assessor <br /> Parcel No. 00480100100100,aka,PARCEL 0 CITY OF EVERETT BLA 08-001 AFN <br /> 200801180378& SURVEY AFN 200801185005 and portions of roadway at 3703 and <br /> 4000 Railway Ave, Everett, WA (the"Property"). <br /> RECITALS <br /> A. Redside desires to utilize property owned by the City for staging <br /> construction materials,as well as ingress and egress for loading and hauling sand to <br /> barge at city owned dock on premises while performing work related to the Nearshore <br /> Restoration Project("Project"). <br /> B. The City is willing to grant Redside Construction,LLC authority to use the <br /> City's property upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration,the receipt <br /> and sufficiency of which is hereby expressly acknowledged,the City licenses Redside <br /> Construction,LLC to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City,and subject to this License, is an area and is more fully set forth as depicted in <br /> Exhibit A,attached hereto,or as otherwise directed by Roy Harris the City's on-site <br /> supervisor. <br /> Section 2. TERM. This License shall be effective at execution of this agreement, <br /> and shall expire on August 30,2016, unless terminated earlier upon 30-days' notice per <br /> Section 7,below. <br /> Section 3. Intentionally Omitted. <br /> Section 4. AUTHORIZED USE. Redside may only use the Property for the <br /> purpose of storing construction equipment and loading,and unloading materials in <br /> conjunction with the Project being performed for the City. Incident to this authorized <br /> use, Redside may install temporary fencing in conformance with Section 16, below. <br /> page I <br />
