CITY <br /> " WASHINGTON STATE DEPARTMENTOF PETER GOLDMARK <br /> Natural Resources Commissioner of Public Lands <br /> MINE <br /> Radio Sharing Agreement <br /> This agreement is made between the Washington State Department of Natural Resources (hereafter <br /> "DNR") and the City of Everett(hereafter"Cooperator"). <br /> WHEREAS, DNR and Cooperator are eligible for and licensed by the Federal Communications <br /> Commission(FCC)to use certain radio frequencies in the Public Safety Pool (47 CFR 90.15) and are <br /> authorized to share Radio Stations under the provisions of the FCC Rules §90.179. <br /> THEREFORE,IT IS AGREED: <br /> 1. DNR and Cooperator shall share radio system components and channels to facilitate public safety <br /> and mutual aid during wildfire and other emergency events. Shared use is intended for inter-agency <br /> communications and, unless otherwise provided for, is not intended for routine operations or to <br /> otherwise supplant the other agency's radio system. <br /> 2. DNR and Cooperator shall share radio system components as defined in Exhibit A—Shared Radio <br /> System Components, which by this reference is made a part hereof. <br /> 3. DNR and Cooperator shall share the radio system components on a non-profit cost share basis. <br /> Unless otherwise provided for, each party shall be responsible for all costs required to configure, <br /> maintain, and repair their radio equipment. <br /> 4. Both parties acknowledge that all shared transmitter use shall be subject to the licensees control as <br /> required by FCC Rule §90.179. <br /> 5. Both parties shall, "Exercise discretion and control to ensure that radios are used only for the <br /> permitted purpose, only in the permissible manner, and only by persons with authority to use and <br /> operate the equipment," as required by FCC Rules §90.403 (a). <br /> 6. All radio transmissions shall include the sending unit identification and the radio station call-sign <br /> indicated in Exhibit A as required by FCC Rule §90.425. <br /> 7. Each parties shall provide points of contact for the administration of this agreement as defined in <br /> Exhibit B—Contact Information, which by this reference is made a part hereof <br /> 8. This agreement may be terminated by either party by providing written notice to the other party's <br /> point of contact; such termination shall be effective upon receipt. <br /> IN WITNESS WHEREOF,the parties hereto have hereunto subscribed their names <br /> Page 1 of 4 <br />
