NOW, THEREFORE,THE EVERETT CITY COUNCIL DOES ORDAIN: <br /> Section 1: Approval of Comprehensive Plan Amendment: Odinance No. 2021-94, as <br /> amended, is hereby amended as followed: <br /> 1. The Comprehensive Plan map designation is hereby amended for the subject property from <br /> Office (4.3) to Mixed Use Commercial Multi Family(4.4) (Exhibit A). <br /> Section 2: Approval of Rezone, Section 2.020 of Ordinance No. 1671-89, as amended <br /> (EMC 19.02.020), is hereby amended as follows: <br /> 1. The zoning of the site is hereby changed from R-1 (Single Family) to B-2 (Community <br /> Business) and from B-2B (Office) to B-2 (Community Business), (Exhibit B), see site and <br /> affected parcel legal descriptions at Exhibit D. <br /> 2. The zoning will be implemented with the attached Development Agreement. <br /> Section 3: Conditions of Approval <br /> 1. Development of the site shall be subject to conditions and requirements of the Development <br /> Agreement, attached hereto by reference and incorporated herein. <br /> 2. Uses of the commercial component of the mixed use project approved herein shall be limited <br /> to: Appliance service and sales, Bakery, Carpet sales, Dry cleaner, Furniture sales, Health and <br /> fitness, Laundromat, Personal services (tailor, beauty, salon), and Retail—indoor, together with <br /> uses allowed in the B-2B zone. <br /> 3. The Planning Department is instructed to amend the Comprehensive Plan and Zoning maps to <br /> reflect the herein enacted Comprehensive Plan map amendments, zone change. <br /> 4. Exhibits A, B, C, and D are hereby made part of this approval and incorporated herein by <br /> reference. <br /> 5. The Mayor is hereby authorized to approve and sign the Development Agreement, containing <br /> Exhibits specified in (4) above, together with B-2 zone use restrictions specified in (2) above. <br /> 6. Any and all improvements to the subject property shall be in conformance with City standards <br /> unless otherwise provided for, as specified herein. <br /> Section 4: The legal description of the area affected by this action is: <br /> See legal description at Exhibit D <br /> - 3 - <br />
