The covered patio encroaches into the required 5' side setback. It appears you are applying the nonconforming <br /> building expansion criteria in EMC 19.38.030; However, I do not see in our records that a Nonconforming <br /> Building Certification (NCB) has been issued for this address. Submitting an NCB application is the first step <br /> required before the nonconforming building could be expanded up to in the setback. Additionally,the covered <br /> patio does not appear to meet the "attached accessory building" criteria in EMC 19.22.020 (see <br /> below). Therefore,this would not be considered an expansion of the nonconforming single-family residence <br /> and the 25%expansion could not be applied. <br /> You mentioned in a previous email that the covered patio/breezeway may be removed. If this is the case, please <br /> revise the plans accordingly. <br /> Note:An uncovered patio may encroach into the side setback if no higher than 42" above existing grade per <br /> EMC 19.06.030. <br /> 2. The height limit is 2 floors up to 28' maximum and the height is measured from the average alley elevation at <br /> the rear lot line per EMC 19.22.060.B.4.a. Please clearly show the height calculations on the elevation drawings. <br /> 3. Please note a survey will be required of the north property line because it is within 1-foot of the 5' setback. This <br /> will be a condition of approval when the permit is issued. <br /> 4. The garage appears to meet the historic design guidelines and as long as it is not attached to the residence,this <br /> would not be considered an addition to the contributing structure and design review by the historical <br /> commission will not be required for a new detached garage. <br /> EMC 19.22.020: <br /> A. 3.
