rr'LL-7.1" <br /> ORDINANCE NO. 2464-00 <br /> AN ORDINANCE Relating to Use of Identifying Information, Adding a New <br /> Section to Chapter 10.56 of the Everett Municipal Code. <br /> WHEREAS, the 2000 Washington State Legislature, finding that it is possible for a <br /> person to cause unwanted magazine subscriptions, merchandise, or other mail to be <br /> delivered to another individual with the intent to harass the recipient, enacted a new law <br /> declaring it a misdemeanor to use any identifying information of another person to solicit <br /> undesired mail directed to that person; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> Unlawful use of identifying information. <br /> A. It is unlawful for any person to knowingly use a means of identification of another <br /> person to solicit undesired mail with the intent to annoy, harass, intimidate, torment, or <br /> embarrass that person. <br /> B. For purposes of this section, "means of identification" has the meaning provided in <br /> RCW 9.35.020. <br /> C. Violation of this section is a misdemeanor. <br /> Section 2: Section 1 of this ordinance shall be codified as a new section in <br /> Chapter 10.56 of the Everett Municipal Code. <br /> Section 3: Severability. <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance or <br /> its application to any person or situation be declared unconstitutional or invalid for any <br /> reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation.
