Page 1 of 1 <br /> Fitness Center Addendum <br /> 08/21/2025 <br /> Property Owner:CP5 Arrive on Seventh,L1.0 <br /> Resident(s):City of Everett-Everett Fire Department and all others occupying the property located at <br /> Dwelling No:/Address:600 7th Avcnue,524,Seattle,WA 98104 <br /> Lease Date:08/21/2025 <br /> Resident(s)recognizes that certain equipment,commonly used for exercising,and an area for its use,(hereinafter <br /> collectively referred to as the"Exercise Room"), have been made available by the Owner to the Resident. The <br /> Resident agrees that use of the Exercise Room shall be restricted to individuals who are of suitable and responsible <br /> age. For health and safety reasons,persons under the age of 16 must be accompanied and supervised by a parent, <br /> guardian,or legal custodian,or a suitable and responsible authorized representative thereof,at all times. A suitable <br /> and responsible representative is defined herein as a person authorized by a parent,guardian,or legal custodian 18 <br /> years of age or older. Resident agrees to use the Exercise Room in a prudent manner,in a manner that is consistent <br /> with the use of an Exercise Room, a manner that is not offensive or dangerous to Resident or any other users, <br /> thereof, and a manner which is in compliance with such policies as shall be established by the Owner or its <br /> representatives in connection with the operation of the Exercise Room. <br /> Resident recognizes that the Owner provides the Exercise Room for Resident use only as an incidental service to the <br /> Resident and its connection with the Resident leasing of the Apartment. The owner shall have the right to <br /> discontinue providing the Exercise Room at any time; that no attendants or supervisors will he provided by the <br /> Owner;and that no representatives have any expertise in the operation of the exercise facilities and equipment Room <br /> and, therefore, resident expressly agrees that use of the facilities in the exercise room by resident, residents <br /> invitees,guests,occupants and any persons present with the resident's knowledge and consent shall be wholly at <br /> residents own risk. Resident agrees to release,hold harmless and indemnify Trinity Property Consultants and <br /> their respective representatives. Resident understands that owner makes no representations or warranties, <br /> express or implied,that the exercise room and/or the equipment or facilities provided in the exercise room are fit <br /> for any particular purpose. Owner disclaims, excludes and denies all warranties and any other implied <br /> warranties as to the physical condition and operation of the equipment and facilities provided in the exercise <br /> room. <br /> To the extent that there is any conflict between the provisions of the Lease and this addendum,the provisions of the <br /> Lease shall be deemed to supersede and amend to that extent. Except as provided herein,the provisions of the Lease <br /> shall remain unaffected. The cost for the Exercise Room key/FOB is$0.00.
