40 :t ORDINANCE NO. st 5 An ordinance providing for the improvement of Twenty-- second Street, from Rucker Avenue to Grand Avenue, by removal of old lumber, grading to proper grade, construction of concrete curbs, con- crete pavement, and doing such other work as may be necessary in con- nection therewith, approving the plans and specifications for such improvement, creating an assessment district, creating a local imp- rovement district fund therefor, providing that payment for said improvement be made by special assessment on property in said district under the mode of "Payment by Bonds". WHEREAS, a majority petition of the property-owners peti- tioning for said improvement has heretofore been filed with the com- missioner of public works, and said commissioner found the things set forth in said petition to be true, and WHEREAS, said commissioner of public works has filed with the city council all data and information in regard to said improve- ment as required by law, and WHEREAS, the commissioner of public works has recommended to the city co-ncil that such improvement petitioned for be made, and it appearing to the city council that public convenience and necess- ity requires said improvement to be made, NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Twentysecond Street from Rucker Avenue to Grand Avenue, be improved by removal of old lumber, grading to proper grade, onetruction of concrete curbs, concrete pavement, and doing such other work as may be necessary in connection therewith, according to plans and specifications prepared under the direction of the city engineer, which said plans and specifications are hereby approved and adopted, Section 2: That the cost and expense of such improvement, including all necessary and incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law„ The city of Everett shall
