NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: The zoning of a portion of the parking lot for the property at 1825 Broadway Avenue, Everett, Washington which is legally described below is hereby amended to B-2 (Community Business): Plat of Everett Division `K', Block 363, Lots 17-18. Section 2: Any use of the property described in Section 1 inconsistent with the terms and conditions of the Resolution of Intent to Rezone and Exhibit A attached thereto, as specified in Resolution No. 4827, a copy of which is attached hereto and incorporated herein by reference, shall be considered a violation of the City of Everett Zoning Code, and shall be subject to the violation and enforcement provisions thereof. Section 3: The City Clerk is hereby instructed to file a duly certified copy of this Ordinance with the attached Resolution with the Auditor of Snohomish County, Washington. Section 4: Severability. If any section, subsection, clause, phrase or any portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
