ORDINANCE NO. 2482-00 <br /> AN ORDINANCE amending Ordinance No. 2097-95 allowing for <br /> outstanding delinquent Downtown Business Improvement Area assessments to be <br /> paid free of accrued interest and penalties during a 90 day period and allowing <br /> credit for certain interest and penalty payments made during the years 1999 and <br /> 2000 by purchasers without notice of delinquent assessment amounts. <br /> WHEREAS, the creation and operation of the Downtown Business Improvement <br /> Area(BIA) has provided substantial improvement to Everett's downtown area; <br /> WHEREAS,the•City and the property owners and businesses of the downtown <br /> business area benefit from the operation of the BIA with the participation of all affected; <br /> WHEREAS, delinquent downtown property and business owners are willing to <br /> bring their assessments current if accrued interest and penalties are waived; <br /> WHEREAS,the Downtown Everett Business Improvement District Advisory <br /> Board has passed a resolution in favor of bringing current, any outstanding delinquent <br /> assessment account, by paying the entire delinquent principal amount, without the <br /> payment of outstanding accrued interest, penalties and fees, if paid within ninety days of <br /> the effective date of the ordinance so providing; <br /> WHEREAS, it is in the best interest of the City of Everett and of downtown <br /> property and business owners to encourage bringing as many assessments current as <br /> possible and allowing credit for certain interest and penalty payments made during the <br /> years 1999 and 2000 by purchasers without notice of delinquent assessments; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section l: Ordinance No. 2097-95 is hereby amended to add the following new sections: <br /> Section . There is hereby declared that any BIA assessment account that is now <br /> delinquent, shall be considered by the City of Everett to be brought current by the <br /> payment of the entire outstanding principal balance of the assessment without payment of <br /> any accrued interest, processing fees or delinquency charges upon such account when <br /> paid within ninety (90) days of the effective date of such ordinance, but not thereafter. <br /> Said ninety day period shall be open and available for all ratepayers in the geographical <br /> area of the BIA, as defined in Ordinance No. 2097-95, to make payment of amounts of <br /> assessments due and delinquent and obtain benefit of the provisions of this section. <br /> 1 <br />
