2 <br />Stevens consistent with Lake Stevens Comprehensive planning efforts and land use regulations, <br />within and adjacent to the Water Corridor. <br />F. To support growth in the region, Everett may construct future additional <br />transmission lines in the Water Corridor. <br />G. Lake Stevens supports the continued and efficient operation and maintenance of the <br />Water Corridor by Everett, and Everett supports the goals of Lake Stevens to allow reasonable <br />private and public development in Lake Stevens adjacent to or crossing the Water Corridor that <br />supports growth in Lake Stevens as part of the region, all subject to the terms and conditions of <br />this Agreement. <br />AGREEMENT <br />The Parties agree as follows: <br />SECTION 1: PROTECTING THE WATER CORRIDOR. <br />This Section 1 establishes the Parties’ agreement regarding all future public and private <br />development relating to the Water Corridor. <br />1.A. Purpose or Purposes of Agreement. <br />This Agreement is authorized by Chapter 39.34 RCW. Lake Stevens is also entering into <br />this Agreement pursuant to Chapter 35A.11 RCW. The purposes and intent of this Agreement are <br />to define the responsibilities of Lake Stevens and Everett as they relate to the protection of the <br />Water Corridor and to define allowed uses, permitting process, noticing requirements, and <br />enforcement process on public and private properties, within and adjacent to the Water Corridor, <br />as detailed below. <br />1.B. Protection of the Water Corridor. <br />1.B.1 Document Marking/GIS. Lake Stevens agrees to mark the location of the Water <br />Corridor in all new plats and in Lake Stevens’ land use and planning documents. Everett displays <br />the location of the Water Corridor on its Geographic Information Systems (GIS). Lake Stevens <br />will display the Water Corridor on its GIS platform and in appropriate planning documents as well. <br />1.B.2 Everett Water Corridor Contact Persons. The Everett Public Works Director <br />will appoint a Water Corridor Contact Person who will be the contact person for Lake Stevens <br />with respect to the Water Corridor. The Lake Stevens City Administrator will appoint a contact <br />person for Lake Stevens with respect to the Water Corridor. <br />1.B.3 Activities Within or Impacting the Water Corridor. Lake Stevens will provide <br />Everett’s Water Corridor Contact Person copies of all permit applications for public or private <br />development or construction within the Water Corridor. Lake Stevens will follow the Lake <br />Stevens permitting procedures identified in Chapters 14.16A and 14.16B of the Lake Stevens <br />Municipal Code (“LSMC”), or as may be amended. Lake Stevens will also provide Everett’s <br />Water Corridor Contact Person copies and other permits within 50-feet of the Water Corridor that <br />may potentially have an impact on the maintenance or operation of the Water Corridor or Everett’s <br />future infrastructure construction within the Water Corridor, including but not limited to land <br />disturbance permits, building permits for new structures and utility installations. Everett will <br />provide specific written comments to Lake Stevens within 14-days of receiving written notice. For <br />all such permit applications, Lake Stevens will give substantial consideration to Everett’s
