City of Everett 00 21 13 - 12 <br />Port Gardner Storage Facility - Facility Construction Package WO# UP-3525 <br /> <br /> <br />00 21 13 - 12 INSTRUCTIONS TO BIDDERS <br />1-03.2 Award of Contract <br />Within 45 days after the opening of Bids, the City will act either to accept the Bid from the <br />lowest responsive, responsible Bidder, or to reject all Bids. The City reserves the right to <br />request extensions of such Bid acceptance period. If the lowest responsible Bidder and <br />the City cannot agree on an extension by the 45 day deadline, the City reserves the right <br />to award the Contract to the next lowest responsible Bidder or reject all Bids. <br />The acceptance of a Bid will be evidenced by a written Notice of Award of Contract <br />delivered to the Bidder whose Bid is accepted, together with a request to furnish bonds <br />and evidence of insurance and to execute the Contract set forth in the Contract <br />Documents. No Contract is formed until the Contract Execution Date. <br />1-03.3 Execution of Contract <br />Successful Bidder has 14 calendar days after receiving the Notice of Award to complete <br />the following: <br />• Provide to the City the information necessary to execute the Contract <br />electronically. This information shall include contact information, including the <br />full name, title, email address, and phone number, for the authorized signer of <br />the Bidder <br />• Submit to the City two original paper payment bonds and two original paper <br />performance bonds submitted on forms contained in Contract Documents and <br />fully executed, with proper power of attorney document(s). <br />• Submit to the City in pdf format certificate of insurance and additional insured <br />endorsements in accordance with the Contract Documents. <br /> <br />After receipt of the information, bonds and insurance documents described above, the <br />Contract will be entered into the City’s AdobeSign system for execution. Contract <br />execution includes execution of the Project Labor Agreement Letter of Assent in the form <br />provided as Exhibit 1 to the PLA and attached to the Agreement (Section 00 52 13). <br />Contractor must execute the Contract (including the letter of assent) within three business <br />days after receipt from the City’s AdobeSign System. <br />Until the City executes a Contract, no Bid shall bind the City nor shall any Work begin <br />within the project limits or within City-furnished sites. The Bidder shall bear all risks for any <br />Work begun outside such areas and for any materials ordered before the Contract is <br />executed by the City. <br />If the Bidder experiences circumstances beyond its control that prevents delivery of bonds, <br />and insurance documents within 14-calendar days after receiving Notice of Award or <br />execution of the Contract within 3 business days after receipt from AdobeSign, the City <br />may grant more time, provided the City deems the circumstances warrant it. <br />A Contract shall not be formed until the Contract is signed by the Mayor. <br />1-03.4 Contract Bonds <br />The Contractor shall provide a separate payment bond and performance bond, each in <br />the amount of 100 percent of the Contract Sum and each in the form contained in the <br />Contract Documents. The bonds must be accompanied by a fully executed and original <br />power of attorney for the officer executing on behalf of the surety.
