A release has been obtained from the Washington State Department of <br />Revenue; and <br />4. Affidavits of Wages Paid for the Contractor and all Subcontractors are on <br />file with the Owner (RCW 39.12.040); and <br />5. A release has been obtained from the Washington State Department of <br />Labor & Industries and the Washington State Employment Security <br />Department; and <br />6. All claims, as provided by law, filed against the retainage have been <br />resolved. In the event claims are filed and provided the conditions one <br />through five are met, the Contractor will be paid the retained percentage <br />less an amount sufficient to pay any such claims together with a sum <br />determined by the Owner sufficient to pay the cost of claims and <br />attorney’s fees. <br />7. All other conditions required by law are satisfied. <br />For the purposes of retainage, the date of “completion of all work” is deemed <br />to be the same date as the date of Final Acceptance.” <br />Item 8 - SPECIFICATION 00 72 00 GENERAL CONDITIONS: <br />Delete the first sentence of Section 11 and Replace with the following: <br />“Upon discovery and before such conditions are disturbed, the Contractor <br />shall provide Notice to the City’s Representative within 14 calendar days of <br />such discovery of:” <br />Item 9 - SPECIFICATION 00 72 00 GENERAL CONDITIONS: <br />Delete Section 11, item 1 and Replace with the following: <br />“Pre-existing subsurface or latent physical conditions at the site differing <br />materially from those indicated in the Contract Documents, or:” <br />Item 10 - SPECIFICATION 00 72 00 GENERAL CONDITIONS: <br />Delete Section 15.2.2 and Replace with the following: <br />“The Contractor shall, prior to the release of Final Payment, furnish separate <br />Maintenance (or Guarantee) Bonds in form acceptable to the Owner written <br />by the same corporate surety that provides the Payment and Performance <br />Bond for this Contract. These bonds shall secure the Contractor's obligation <br />to replace or repair defective materials and faulty workmanship for a minimum <br />period of two (2) years after Final Payment and shall be written in an amount <br />equal to one hundred percent (100%) of the Contract Sum, as adjusted (if at <br />all).”
