31 <br />ARTICLE 16 - SENIORITY <br /> <br />Section 1: <br />Working seniority (adjusted employment date) will be determined from the date of hire as an <br />employee covered under Article 4 for the City provided such service is continuous. Working <br />seniority applies only to City benefits, such as vacation accrual and longevity accrual. <br /> <br />Union seniority applies to days off, run selection, vacation bids, holiday bids, overtime, and <br />revenue vehicle bidding (when applicable). Union seniority belongs to the Union. If there are any <br />issues about union seniority, it shall be settled by the Union. <br /> <br />Section 2: <br />Seniority shall be recognized in the same classification of work and those having greater seniority <br />shall be given preference as to work in the same position but shall not be in conflict with the rules <br />of Civil Service as it applies to promotions. If there is a layoff in the operator series, prior <br />paratransit operator time will be included in that individual’s class of bus operator time for <br />purposes of determining layoff seniority. <br /> <br />Section 3: <br />Seniority shall terminate by discharge from service or by voluntarily leaving the service of the <br />Transit Division. <br /> <br />Section 4: <br />When and if it becomes necessary to lay-off any employee, the last person hired in each <br />classification shall be the first laid off and the last person laid off shall be the first person hired <br />when rehiring. <br /> <br />Section 5: <br />Employees under a medical leave of absence will not lose their seniority rights for one (1) year <br />after their accrued sick leave is exhausted. During this period, the City has the right to require <br />physician reports every 90 days, and to send the individual to a City-appointed physician. (See <br />Article 11, Section 8.) <br /> <br /> <br />
