ORDINANCA NO. I_- :Y'' An ordinannce amending Section 4 of Ordinance No. 1649 of the city of Averett, passed April 20, 1915 , and published April 22, 1915, and entitled "An ordinance providing for the opening up and establishing of an alley in the replat of block 725, plat of Averett, Division "H" , in the city of Averett, and directing the city attorney to institute condemnation proceedings for the purpose of acquiring the land necessary for that purpose, and providing for the levy of special assessments upon the land benefited thereby to pay the cost thereof. " THE CITY OP AVARATT DOTS ORDAIN: Section 1: That Section 4 of Ordinance No. 1649 of the city of Averett, passed April 20, 1915, and published April 22, 1915, and entitled as above set forth, be, and the same is hereby amended to read as follows: Section 4: An assessment shall be made and levied in the manner provided by law for the purpose of raising the amount nec- essary to pay the compensation and damages which 4hall be obtained for the property taken or damaged as aforesaid, together with the cost of the proceedings to be had therein, including also the cost of making, levying and collecting said assessment. Said assessment shall be made subject to the provisions of law on all property spec.. ially benefited by said opening up and establishing of said alley, as herein provided. The cost and expense of the opening up and establishing of said alley shall be paid wholly by special assessment upon the property benefited by said improvement, provided that no property shall be assessed a greater amount than it will be actually benefited, and provided, further, that if an assessment upon said property in said district to the full amount it has been benefited will not defray all the cost and expense of such improvement the balance shall be paid from the general fund of the city of Averett.
