G. All projects must be in compliance with the approved grading plan prior to final approval being <br /> granted. The planning director or city engineer may require a final as-built topography map to <br /> show compliance with the approved grading plan and to calculate building height as required by <br /> Chapters 19.24 through 19.27 EMC and this title. (Ord.3774-20§5(N)(Exh. 3),2020.) <br /> The parking of vehicles upon nonapproved surfaces, including gravel,dirt and grass,fails to meet City <br /> Parking Area Design &Surfacing Requirements, in violation of Everett Municipal Code (EMC) 19.34.120 <br /> B.1,and EMC 19.41.020 B,which read: <br /> • EMC 19.34.120 Parking area design and construction. <br /> B. Surfacing. <br /> 1. All parking areas shall consist of durable surface materials approved by the planning <br /> director and city engineer. Depending upon site and soil conditions, low impact development <br /> (LID)stormwater management facilities are encouraged, and may be required by the city's <br /> stormwater management manual. <br /> *** <br /> EMC 19.41.020 Enforcement,violation and penalties. <br /> A. Enforcement.Enforcement of the provisions of this title and of any permits or approvals issued <br /> pursuant thereto shall be performed in accordance with the procedures established in this title and <br /> Chapter 1.20 EMC. <br /> B. Violation. No person,firm, association, corporation or any agent thereof shall violate or fail to <br /> comply with any provisions of this title nor use any property, erect <br /> any structure, occupy or use any structure or place any improvement on any property in violation <br /> of any provision of this title. Each such person,firm, association, corporation or agent <br /> thereof shall be deemed guilty of a separate offense for each and every day during which any <br /> violation of any provision of this title is committed, continued or permitted. <br /> CORRECTIVE ACTIONS REQUIRED: The Responsible Person(s)shall take the following actions to correct the <br /> Code Violations at the Property: <br /> 1. Cease parking upon the unpermitted parking areas. <br /> 2. Contact the City of Everett Public Works Division located at 3200 Cedar Street and submit <br /> applications for all necessary permits for the unpermitted grading and clearing activities and <br /> creation of new parking areas,to bring the property and right-of-way easement into compliance <br /> with the Everett Municipal.Once the permit is issued to either keep improvements or to restore <br /> property to a compliant state,then,correct and complete all of the deficiencies that are present <br /> on the property and have the work inspected and approved, by the Everett City Public Works <br /> Division. <br /> Corrective actions must be completed by February 24, 2025 <br /> Note that all required permits(if applicable)to perform the corrective action must be obtained from the <br /> proper issuing agency. <br /> Notice and Order Page 3 of 5 <br />
