Industrial insurance coverage for the Subcontractor’s employees working in Washington as required in Title 51 RCW; b. An employment security department number as required in Title 50 RCW; c. A state excise tax registration number as required in Title 82 RCW; d. An electrical contractor license, if required by Chapter 19.28 RCW; e. An elevator contractor license, if required by Chapter 70.87 RCW. 4. Not be disqualified from bidding on any public works contract under RCW 39.06.010 or 39.12.065(3). 5. If bidding on a public works project subject to the apprenticeship utilization requirements in RCW 39.04.320, not have been found out of compliance by the Washington state apprenticeship and training council for working apprentices out of ratio, without appropriate supervision, or outside their approved work processes as outlined in their standards of apprenticeship under chapter 49.04 RCW for the one-year period immediately preceding the date of the bid solicitation; 6. Within the three-year period immediately preceding the date of the bid solicitation, not have been determined by a final and binding citation and notice of assessment issued by the department of labor and industries or through a civil judgment entered by a court of limited or general jurisdiction to have willfully violated, as defined in RCW 49.48.082, any provision of chapter 49.46, 49.48, or 49.52 RCW; and 7. Have received training on the requirements related to public works and prevailing wage under in accordance with the requirements of RCW 39.04.350(f), or demonstrate exemption from such requirements. The Contract Documents shall apply to Subcontractors and Suppliers as if each had signed the Contract with the Owner. Contractor shall include the provisions of these Contract Documents or a “flow down” clause in each contract with Subcontractors and Suppliers. 4.4. RESPONSIBILITIES 4.4.1. Subcontractors, Manufacturers and Suppliers The Contractor shall be responsible for the adequacy, efficiency and sufficiency of Subcontractors, manufacturers, Suppliers and their employees. 4.4.2. Contractor's Employees The Contractor shall be responsible for the adequacy, efficiency and sufficiency of its employees. Workers shall have sufficient knowledge, skill and experience to perform properly the Work assigned to them. 4.4.3. Payment for Labor and Materials The Contractor shall pay and require its Subcontractors to pay any and all accounts for labor including Worker's Compensation premiums, State Unemployment and Federal Social Security payments and other wage and salary deductions required by law. The Contractor also shall pay and cause its Subcontractors to pay any and all accounts for services, Equipment, and materials used by him and its Subcontractors during the performance of Work under this Contract. The Contractor shall pay such accounts as they become due and payable. If requested by the Owner, the Contractor shall promptly furnish proof of payment of such accounts to the Owner.
