Whenever items of work are listed in <br />4 the Contract Provisions for operational testing they shall be fully tested under operating <br />5 conditions for the time period specified to ensure their acceptability prior to the Physical <br />6 Completion Date. During and following the test period, the Contractor shall correct any <br />7 items of workmanship, materials, or equipment which prove faulty, or that are not in first <br />8 class operating condition. Equipment, electrical controls, meters, or other devices and <br />9 equipment to be tested during this period shall be tested under the observation of the <br />10 Engineer, so that the Engineer may determine their suitability for the purpose for which <br />11 they were installed. The Physical Completion Date cannot be established until testing and <br />12 corrections have been completed to the satisfaction of the Engineer. <br />13 <br />14 The costs for power, gas, labor, material, supplies, and everything else needed to <br />15 successfully complete operational testing, shall be included in the unit contract prices <br />16 related to the system being tested, unless specifically set forth otherwise in the proposal. <br />17 <br />18 Operational and test periods, when required by the Engineer, shall not affect a <br />19 manufacturers guaranties or warranties furnished under the terms of the contract. <br />20 <br />21 <br />22 1-05.13.RTF <br />23 1-05.13 Superintendents, Labor, and Equipment of Contractor <br />24 (August 14, 2013 APWA GSP) <br />25 <br />26 Delete the sixth and seventh paragraphs of this section. <br />27 <br />28 1-05.15.RTF <br />29 1-05.15 Method of Serving Notices <br />30 (January 4, 2024 APWA GSP) <br />31 <br />32 Revise the second paragraph to read: <br />33 <br />34 All correspondence from the Contractor shall be served and directed to the Engineer. <br />35 All correspondence from the Contractor constituting any notification, notice of protest, <br />36 notice of dispute, or other correspondence constituting notification required to be <br />37 furnished under the Contract, must be written in paper format, hand delivered or sent <br />38 via certified mail delivery service with return receipt requested to the Engineer’s office. <br />39 Electronic copies such as e-mails or electronically delivered copies of correspondence <br />40 will not constitute such notice and will not comply with the requirements of the <br />41 Contract. <br />42 <br />43 1-05.16.RTF <br />44 Add the following new section: <br />45 <br />46 1-05.16 Water and Power <br />47 (October 1, 2005 APWA GSP) <br />48 <br />49 The Contractor shall make necessary arrangements, and shall bear the costs for power <br />50 and water necessary for the performance of the work, unless the contract includes power <br />51 and water as a pay item. <br />52
