If substantial completion has been granted and all the authorized 27 working days have been used, charging of working days will cease. Each week the 28 Engineer will provide the Contractor a statement that shows the number of working days: 29 (1) charged to the contract the week before; (2) specified for the physical completion of 30 the contract; and (3) remaining for the physical completion of the contract. The statement 31 will also show the nonworking days and all partial or whole days the Engineer declares as 32 unworkable The statement will be identified as a Written Determination by the Engineer. If 33 the Contractor does not agree with the Written Determination of working days, the 34 Contractor shall pursue the protest procedures in accordance with Section 1-04.5. By 35 failing to follow the procedures of Section 1-04.5, the Contractor shall be deemed as 36 having accepted the statement as correct. If the Contractor is approved to work 10 hours 37 a day and 4 days a week (a 4-10 schedule) and the fifth day of the week in which a 4-10 38 shift is worked would ordinarily be charged as a working day then the fifth day of that 39 week will be charged as a working day whether or not the Contractor works on that day. 40 41 Revise the sixth paragraph to read: 42 43 The Engineer will give the Contractor written notice of the completion date of the contract 44 after all the Contractors obligations under the contract have been performed by the 45 Contractor. The following events must occur before the Completion Date can be 46 established: 47 1. The physical work on the project must be complete; and 48 2. The Contractor must furnish all documentation required by the contract and required 49 by law, to allow the Contracting Agency to process final acceptance of the contract.
