If substantial completion has been granted and all the authorized <br />27 working days have been used, charging of working days will cease. Each week the <br />28 Engineer will provide the Contractor a statement that shows the number of working days: <br />29 (1) charged to the contract the week before; (2) specified for the physical completion of <br />30 the contract; and (3) remaining for the physical completion of the contract. The statement <br />31 will also show the nonworking days and all partial or whole days the Engineer declares as <br />32 unworkable The statement will be identified as a Written Determination by the Engineer. If <br />33 the Contractor does not agree with the Written Determination of working days, the <br />34 Contractor shall pursue the protest procedures in accordance with Section 1-04.5. By <br />35 failing to follow the procedures of Section 1-04.5, the Contractor shall be deemed as <br />36 having accepted the statement as correct. If the Contractor is approved to work 10 hours <br />37 a day and 4 days a week (a 4-10 schedule) and the fifth day of the week in which a 4-10 <br />38 shift is worked would ordinarily be charged as a working day then the fifth day of that <br />39 week will be charged as a working day whether or not the Contractor works on that day. <br />40 <br />41 Revise the sixth paragraph to read: <br />42 <br />43 The Engineer will give the Contractor written notice of the completion date of the contract <br />44 after all the Contractors obligations under the contract have been performed by the <br />45 Contractor. The following events must occur before the Completion Date can be <br />46 established: <br />47 1. The physical work on the project must be complete; and <br />48 2. The Contractor must furnish all documentation required by the contract and required <br />49 by law, to allow the Contracting Agency to process final acceptance of the contract.
