RRFB PEDESTRIAN SAFETY October 31, 2025 <br />STATE FUND # HLP-PB25(004) <br />WO 3807 <br />Page 43 of 82 <br />1 1-08.9.OptionB.RTF <br />2 1-08.9 Liquidated Damages <br />3 (March 3, 2021 APWA GSP, Option B) <br />4 <br />5 Revise the second and third paragraphs to read: <br />6 <br />7 Accordingly, the Contractor agrees: <br />8 <br />9 1. To pay (according to the following formula) liquidated damages for each <br />10 working day beyond the number of working days established for Physical <br />11 Completion, and <br />12 <br />13 2. To authorize the Engineer to deduct these liquidated damages from any <br />14 money due or coming due to the Contractor. <br />15 <br />16 Liquidated Damages Formula <br />17 <br />18 LD=0.15C/T <br />19 <br />20 Where: <br />21 <br />22 LD = liquidated damages per working day (rounded to the nearest dollar) <br />23 C = original Contract amount <br />24 T = original time for Physical Completion <br />25 <br />26 When the Contract Work has progressed to Substantial Completion as defined in the <br />27 Contract, the Engineer may determine the Contract Work is Substantially Complete. The <br />28 Engineer will notify the Contractor in writing of the Substantial Completion Date. For <br />29 overruns in Contract time occurring after the date so established, the formula for <br />30 liquidated damages shown above will not apply. For overruns in Contract time occurring <br />31 after the Substantial Completion Date, liquidated damages shall be assessed on the basis <br />32 of direct engineering and related costs assignable to the project until the actual Physical <br />33 Completion Date of all the Contract Work. The Contractor shall complete the remaining <br />34 Work as promptly as possible. Upon request by the Project Engineer, the Contractor shall <br />35 furnish a written schedule for completing the physical Work on the Contract. <br />36 <br />37 1-09.GR1 <br />38 Measurement and Payment <br />39 <br />40 1-09.6.RTF <br />41 1-09.6 Force Account <br />42 (December 30, 2022 APWA GSP) <br />43 <br />44 Supplement this section with the following: <br />45 <br />46 The Contracting Agency has estimated and included in the Proposal, dollar amounts for all <br />47 items to be paid per force account, only to provide a common proposal for Bidders.
