M <br />homeowner. A restrictive covenant to be recorded with the <br />County Auditor shall be filed by the applicant for the City's <br />review and approval at such time that final subdivision or <br />short subdivision approval is requested specifying the <br />homeowner's maintenance responsibilities as provided <br />herein. <br />ii) The maintenance of all common landscaping areas within <br />this project shall be the responsibility and expense of the <br />applicant, developer, builder or property owner until such <br />time as a certificate of occupancy is issued for the lot and <br />sold to a homeowner, then said maintenance responsibility <br />shall transfer to the homeowner. A restrictive covenant to be <br />recorded with the County Auditor shall be filed by the <br />applicant for the City's review and approval at such time that <br />final subdivision or short subdivision approval is requested <br />specifying the homeowner's maintenance responsibilities as <br />provided herein. <br />The following note must be placed on the Final Map as a <br />"CONDITION OF SHORT SUBDIVISION APPROVAL: <br />a) Residential landscaping in the front yard is required to be <br />competed prior to occupancy permits per EMC Chapter <br />18.28.080 F: <br />b) Each lot is required to provide private yard area (open <br />space) as defined in EMC Chapter 18.28.250; <br />c) It will be the responsibility of the property owner to maintain <br />the street trees on the individual lots on which each tree or <br />trees are located; <br />d) Garages - Lots 1 -3 are required to provide 2 car garages <br />meeting minimum size a setbacks per EMC 18.28.140. <br />e) Tract 999 is an ESA Critical Area Tract and must be <br />maintained accordance with the City' Critical Area <br />Ordinance. This area must be kept in its natural state <br />consistent with EMC 19.37. Any such violation shall be <br />subject to the Enforcement Section of EMC 19.37.260. <br />Tract 999 as shown shall be designated as a Critical Area per EMC <br />19.37. A split rail fence and Critical Area signs are required to <br />delineate this Tract. The fencing, signs, and critical area must be <br />maintained by the property owners per EMC 19.37. <br />' 6. A water services and sewer stubs must be installed to each lot per <br />City standards prior to final approval. <br />
