ORDINANCE NO. 2509-01 AN ORDINANCE providing for the acquisition of certain property for the purpose of constructing the California Street Overcrossing;providing for the condemnation, appropriation, taking and damaging of land or other property necessary therefore; directing the City Attorney to prosecute the appropriate action and proceedings in the manner provided by law for said condemnation. WHEREAS, the acquisition of the property for and the construction of the California Street Overcrossing is an important part of the City's transportation plan. The California Street Overcrossing is a part of the FAST Corridor project designed to increase freight mobility and eliminate at grade crossings. The California Street Overcrossing will provide direct access to Kimberly Clark and the Port of Everett's South Terminal which are currently served by three at grade railroad crossings. The construction of the California Street Overcrossing will provide safer, unimpeded and more reliable access to this part of the City's waterfront; and WHEREAS,the City has unsuccessfully attempted to negotiate the purchase of the private property legally described in Exhibit "1" ("Property") which is attached hereto and incorporated herein by reference from the owners thereof which property is to be used for the construction of the California Street Overcrossing; and WHEREAS,in view of the impasse reached with the property owners,the City Council has elected to condemn the Property which is necessary for completion of the California Street Overcrossing Project;
