Costs and Expenses to be Borne by Grantee <br /> Grantee shall reimburse the City for all costs and expenses of preparation and publication of this <br /> Franchise and any Ordinance related hereto. <br /> 13.4. Binding Effect <br /> This Franchise shall be binding upon the parties hereto,their permitted successors and assigns. <br /> 13.5. Authority to Amend <br /> This Franchise may be amended at any time by written agreement between the parties. <br /> 13.6. No Joint Venture <br /> Nothing herein shall be deemed to create a joint venture or principal-agent relationship between the <br /> parties, and neither party is authorized to, nor shall either party act toward third Persons or the <br /> public in any manner that would indicate any such relationship with the other. <br /> 13.7. Waiver <br /> The failure of the City at any time to require performance by the Grantee of any provision hereof <br /> shall in no way affect the right of the City hereafter to enforce the same.
