ORDINANCA NO. <br /> An ordinance appropriating the sum of $638.39 from the <br /> General Fund of the city of Averett, for the purpose of paying for <br /> the making of repairs on Hewitt Avenue, and authorizing and directing <br /> the mayor and city clerk to issue a warrant on the Miscellaneous <br /> Fund in the sum of $638.39 to the Gray' s Harbor Construction Company <br /> in partial payment for making such repairs, and declaring an emer- <br /> gency. <br /> WHLRLAS, In 1906 the city of Averett entered into a con- <br /> tract with George McKenzie for the maintenance of certain portions <br /> of Hewitt Avenue , and said City agreed to pay the said George <br /> McKenzie certain annual payments for the maintenance of said Hewitt <br /> Avenue, and <br /> WH RAAS , Said contract provided that in the event that <br /> said George McKenzie should fail to keep said Hewitt Avenue in repair, <br /> as provided in said contract, the city of Averett should make such <br /> repairs and charge the same to said George McKenzie, and <br /> WH{:RI AS , The said George McKenzie has failed and refused <br /> to make repairs on said Hewitt Avenue, and the Commissioner of <br /> Public Works has entered into a contract with the Gray' s Harbor <br /> Construction Company for the making of such repairs on said Hewitt <br /> Avenues <br /> NOW TH+i'RAFORA, THA CITY OP J'VLRJ TT DOES ORDAIN: <br /> Section 1: That there be and hereby is appropriated from <br /> the General Fund of the city of Averett the sum of *638.39, for the <br /> purpose of making the necessary repairs on Hewitt Avenue in said City. <br /> Section 2: That upon the completion of said repairs ,and <br /> the acceptance of the same by the Commissioner of Public Works of the <br /> city of Averett, that the mayor and city clerk be and they are hereby <br /> authorized to issue a warrant to the Gray' s Harbor Construction Comp- <br /> any in the sum of $638.39 in partial payment for repairing said <br />
