City of Everett Everett Station HVAC and Controls Improvements 00 21 13 - 5 <br /> <br /> <br /> <br />00 21 13 - 5 INSTRUCTIONS TO BIDDERS <br />The Bidder shall be familiar and comply with all Federal, State, tribal, and local laws, <br />ordinances, and regulations which might affect those engaged in the Work. The City will <br />not consider any plea of misunderstanding or ignorance of such requirements. <br />Bid prices shall include everything necessary for the completion of the Work including, <br />but not limited to, providing the materials, equipment, tools, plant and other facilities, and <br />the management, superintendence, labor, and all necessary testing services. <br />Prospective Bidders are advised that projects with Work on or adjacent to water may <br />require insurance coverage in compliance with: <br />1. The Longshoremen’s and Harbor Worker’s Compensation Act <br />(administered by U.S. Department of Labor), or <br />2. The State Industrial Insurance (administrated by the Washington State <br />Department of Labor and Industries), or <br />3. Both. <br />The Contractor shall bear all cost for such insurance as provided in the Contract <br />Documents. <br />No Claim shall be allowed because of any ambiguity in the Contract if: <br />1. The Bidder discovers an ambiguity but fails to notify the City, or <br />2. The Bidder failed to discover a patent ambiguity that would be discovered <br />by a reasonably prudent contractor in preparing its Bid. <br />Any prospective Bidder desiring an explanation or interpretation of the Bid Documents, <br />shall request the explanation or interpretation in writing by close of business seven <br />business days preceding the Bid opening to allow a written reply to reach all prospective <br />Bidders before the submission of their Bids. <br />Bidder acknowledges that the Bidder has not relied on representation or warranty of the <br />City not expressly included in the Contract Documents. <br />The information provided by the City is not intended to be a substitute for, or a <br />supplement to, the independent verification by the Bidder to the extent such independent <br />investigation of the Drawings and Specifications or Site conditions is deemed necessary <br />or desirable by the Bidder. Bidder acknowledges that they have not relied upon City or <br />Engineer furnished information regarding site conditions in preparing and submitting a <br />Bid. <br />1-02.4(1)A Interpretation of Contract Documents <br />Should a Bidder find what is believed to be discrepancies in or omissions from the <br />Plans, Specifications, or any other Contract Document, or should the Bidder be in <br />doubt as to their meaning, Bidder may submit to the City a written request for an <br />interpretation thereof. The Bidder submitting the request will be responsible for its <br />prompt delivery. Any interpretation of the documents, if made, will be made only by <br />addendum duly issued. All requests for interpretations must be received by <br />the City, Architect or Engineer no later than 7 calendar days prior to the bid <br />opening date. All questions regarding the Contract Documents shall be referred to <br />the City at the address provided in the Contract Documents. <br />1-02.4(1)B Prevailing Wages <br />Bidder is directed to the Contract Documents for requirements regarding applying <br />payment of prevailing wage rates for employment of labor on within Snohomish <br />County.
