CITY OF EVERETT BID SET <br />EVERETT STATION HVAC AND CONTROLS IMPROVEMENTS <br />PROJECT NO. 24-3201 <br /> <br />01 25 00 -5 SUBSTITUTION PROCEDURES <br /> UNSUITABILITY: Subsequent information or changes disclose inability of the specified item to <br />perform as intended. <br /> REGULATORY REQUIREMENTS: Final interpretation of code, regulatory requirements, safety <br />requirements, or insurance requirements necessitate a change due to inability of the specified item <br />to conform. <br /> WARRANTY: Manufacturer or fabricator cannot certify or warrant performance of specified item <br />as required. <br /> OWNER'S BENEFIT: In the judgment of the Architect, acceptance of the proposed substitution is <br />clearly in the Owner's best interest because of cost, quality, or other consideration. In requesting <br />a substitution under this clause, the Contractor shall furnish substantiation of any such reason. <br /> Substitutions will not be considered if they are indicated or implied on shop drawings or other project data <br />submittals, without proper notice shown on Section 00 63 25. <br /> WORK-RELATED SUBMITTALS: Contractor's submittal of, and Architect's acceptance of, shop drawings, <br />product data or samples which indicate work not complying with requirements of contract documents, does <br />not constitute an acceptable and valid request for, nor approval of, a substitution. <br /> GENERAL CONDITIONS: To this extent this Section is inconsistent with Subsection 8.5 of Section 00 72 00 <br />General Conditions, the requirement most stringent on the Contractor governs. <br />PRODUCTS (NOT USED) <br />EXECUTION (NOT USED) <br />END OF SECTION 01 25 00 <br /> <br /> <br /> <br />
