Category 2: Sensitive information <br />9.34 All equipment installed shall be properly licensed. All tenant FCC, IRAC, and amateur <br />radio licenses shall be posted. <br />9.35 Special on -site uses may be subject to additional limitations beyond those described <br />herein. Special site users shall be notified of such additional limitations in writing. <br />9.36 Upon request, the Licensor will attempt to provide an accurate record of all transmitters <br />located at the sites to include frequency, power, antenna type, antenna attachment location, <br />azimuth, beam width, and FCC License (when applicable). <br />10. LIENS <br />10.1 Licensee must keep the Site free from any liens arising from any work performed, <br />materials furnished, or obligations incurred by or at the request of the Licensee. <br />10.2 If any lien is filed against the Site as a result of the acts or omissions of Licensee, or <br />Licensee's employees, agents, or contractors, Licensee must discharge the lien or bond <br />the lien off in a manner reasonably satisfactory to Licensor within thirty (30) days after <br />Licensee receives written notice from any party that the lien has been filed. <br />10.3 If Licensee fails to discharge or bond any lien within such period, then, in addition to <br />any other right or remedy of Licensor, Licensor may discharge the lien by either paying the <br />amount claimed to be due or obtaining the discharge by deposit with a court or a title <br />company or by bonding, and/or terminate Licensee's rights to the Site(s). <br />10.4 Licensee must pay on demand any amount paid by Licensor for the discharge or <br />satisfaction of any lien, and all reasonable attorney's fees and other legal expenses of <br />Licensor incurred in defending any such action or in obtaining the discharge of such lien, <br />together with all reasonable disbursements in connection therewith. <br />11. ELECTRICAL UTILITY SERVICE <br />The Licensee will pay for all utilities that support their Communications Facilities. Utility billing <br />will be direct to the Licensee by the utility and a separate electrical service established <br />wherever possible. <br />In the case of the Licensee locating within a building operated by the Licensor, Licensee may <br />arrange for the installation of a separately metered panel to isolate their charges for direct <br />payment to the utility. The exact location of proposed utility routes and the manner of <br />installation will be part of the SLA described in this Agreement. <br />In certain situations, when Licensee's Communications Facilities meets certain standards and <br />fixed Toad criteria it may with prior agreement from Licensor, utilize the Licensor's electrical <br />service and equipment. In this case, a mutually agreed -upon rate will be established in the <br />SLA that the Licensee will pay the Licensor for the electrical services provided. <br />SNO911 Master License Agreement 2025 Page 15 <br />Category 2: For official use only / disclosure permissible by law. <br />
