Category 2: Sensitive information <br />o n or across any Site without Licensor's prior written approval, except that Licensee may keep <br />o n the Site substances used in back up power units, such as batteries and diesel generators <br />commonly used in the wireless telecommunications industry. Licensee's use, storage, <br />handling, and disposal of any approved substances constituting Environmental Hazards must <br />comply with all applicable laws, ordinances, regulations and other provisions of this <br />Agreement governing such use, storage, handling and disposal. Under no circumstances will <br />Licensee dispose of any Environmental Hazards or pollutants on any Site. <br />21.3 The term "Environmental Hazards" means hazardous substances (as defined in RCW <br />Section 70.1050.020(5)), hazardous wastes, pollutants, asbestos, polychlorinated biphenyl <br />(PCB), petroleum or other fuels (including crude oil or any fraction or derivative thereof) and <br />u nderground storage tanks. The term "hazardous substances" shall be defined in the <br />Comprehensive Environmental Response, Compensation, and Liability Act, and any <br />regulations promulgated pursuant thereto. The term "pollutants" shall be as defined in the <br />Clean Water Act (33 USC Section 1251, et seq.), and any regulations promulgated pursuant <br />thereto. The term "remediate" shall be defined as all actions necessary to satisfy the <br />requirements of the Model Toxics Control Act (RCW Chapter 70 1050) and the <br />Comprehensive Environmental Response, Compensation and Liability Act (42 USC Section <br />9601, et seq.) and any regulations promulgated pursuant thereto. <br />21.4 This provision shall survive termination of the Agreement and any particular SLA. <br />22. SUBORDINATION <br />22.1 Licensee agrees that this Agreement and each SLA is subject and subordinate at all <br />times to the lien of all mortgages and deeds of trust securing any amount or amounts <br />whatsoever which may now exist or hereafter be placed on or against the Site or on or against <br />Licensor's interest or estate therein, and any underlying ground license or other agreements <br />and licenses on a particular Site, all without the necessity of having further instruments <br />executed by Licensee to effect such subordination but with respect to any such liens, leases, <br />and licenses arising subsequent to the execution of this Agreement only if trustees or <br />mortgagees will not disturb Licensee under this Agreement and the SLAs. <br />22.2 Each SLA is subject to any restrictions or other terms or conditions contained in the <br />underlying ground license, tower license, easement, license, franchise, permit or other <br />instrument of authorization or conveyance ("Instrument") with respect to a particular Site. <br />Licensee agrees to commit no act or omission which would constitute a violation of the terms <br />and conditions of any Instrument for a particular Site. <br />(a) Licensor shall not be required to obtain any consent required under any Instrument <br />from the landlord or other party to such Instrument for purposes of this Agreement, <br />unless expressly set forth in the SLA. <br />(b) If a restriction contained in an Instrument for a particular Site and not set forth on <br />SNO911 Master License Agreement 2025 Page 22 <br />Category 2: For official use only / disclosure permissible by law. <br />
