ORDINANCE NO. 2516-01 <br /> AN ORDINANCE GRANTING AN EXTENSION OF THE CABLE TELEVISION <br /> FRANCHISE NOW HELD BY AT&T. <br /> WHEREAS, the City granted Everett Cablevision, Inc., a Washington corporation doing <br /> business as Viacom Cablevision, a franchise to provide cable television services in the City in <br /> ordinance no. 1140-85; and <br /> WHEREAS, the City approved the assignment and transfer of the franchise to an investor <br /> group led by Viacom's senior management on December 10, 1986 by Resolution no. 2793; and <br /> WHEREAS, the City consented to the merger of Telecommunications, Inc. ("TCI"), the <br /> corporate parent of Viacom,with AT&T Corp. by Resolution 4686 on November 18, 1998; and <br /> WHEREAS,the franchise expires on July 11,2001 pursuant to Ordinance no. 2457-00; and <br /> WHEREAS, the City and AT&T are presently negotiating a renewed franchise consistent <br /> with federal and state laws regulating such franchises; and <br /> WHEREAS, both the City and AT&T desire to continue negotiating but do not desire to <br /> interrupt cable television service in Everett; <br /> WHEREAS, AT&T and the City find it mutually beneficial to extend the existing franchise <br /> for a reasonable period of time in order to promote and facilitate an orderly franchise renewal <br /> process. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Finding. The City finds the franchise extension approved by this ordinance is in <br /> the interest of the public. <br /> Section 2. Franchise Extension. Pursuant to Ordinance 1138-85 ,32 (1985) (EMC <br /> 5.116.320, the City hereby extends the current cable television franchise held by AT&T for a period <br /> not to exceed six (6) months, from and including July 11, 2001, through and including January 10, <br /> 2002. This section supersedes any contrary provision of Section 2 of Ordinance 1140-85, and of <br /> Ordinance No. 2457-00. <br /> Ordinance -1 <br />
