DUTY TO OB.c+JY REGULATIONS. <br /> Section 37: It shall be the duty of persons within the <br /> city of Averett to maintain the premises of which they are the <br /> owners. agents or occupants , in the condition required by the terms <br /> of this ordinance, and to obey all orders and regulations issued by <br /> the health officer or the Board of Health of said city. The failure <br /> or refusal of any person so to do shall be considered a violation <br /> of this ordinance, and the creation, maintenance or suffering to <br /> 4//exist of any condition contrary to the provisions of this ordinance <br /> shall be, and the same is hereby declared to be a nuisance, and any <br /> person or persons creating, maintaining or suffering the same to <br /> exist shall be deemed guilty of violating this ordinance. <br /> ABATAMANT OF NUISANCAS. <br /> Section 38: Whenever the health officer shall find any <br /> person violating this ordinance or maintaining or permitting a nuisan- <br /> ce in the city, or any nuisance being created, maintained or suffer- <br /> ed to remain in or upon any premises in said city, he shall notify <br /> such person owning, occupying or having charge or control of such <br /> premises , to abate such nuisance within such time as he shall deem <br /> advisable, not less than twenty-four (24) hours from the time of the <br /> service of such notice as herein provided; in the event of the refusal <br /> or failure of such person or persons to abate such nuisance within <br /> said time, the health officer shall cause such nuisance to be abated <br /> at the expense of such person or persons , which cost may be recovered <br /> by the city from such person or persons in an action brought in the <br /> name of said city to recover the same in any court of competent <br /> jurisdiction. Such notice shall be served in the following manner: <br /> by delivering a copy of the same to such person, or by leaving a copy <br /> of the same with some person at the residence of such person, or by <br /> posting a copy of the same in a conspicuous place on the residence <br /> premises of such person, or on the premises where such nuisance is <br /> created, permitted or maintained.
