ORDINANCE NO. 2517-01 <br /> AN ORDNANCE amending gambling tax Ordinance 1023-84, 1984 as <br /> amended by Ordinance 2265-98 § 3 1998; Ordinance 2264-98 § 1, 1998; <br /> Ordinance 1301-86 § 1 (part), 1986 and Chapter 3.36 Everett Municipal Code <br /> providing for remedies and sanctions for non-compliance including possible loss <br /> of City business license. <br /> WHEREAS, for purposes of enforcing criminal sanctions of the current gambling <br /> tax ordinance for violations of the Chapter 3.36 Everett Municipal Code (EMC), the <br /> addition of a provision making a violation of Chapter 3.36 EMC also a violation of state <br /> law, Chapter 9.46. RCW would provide needed support and state law connection for any <br /> prosecution; and <br /> WHEREAS, in enforcing the City's collection duties under the gambling tax <br /> ordinance, the City of Everett has experienced instances in which businesses conduct <br /> various gambling activities, notwithstanding the fact they have failed to pay the City's <br /> gambling tax, are delinquent in their tax payments and continue operation without paying <br /> the City's gambling tax, interest and/or penalties when due; and <br /> WHEREAS, business conducting various gambling activities currently report to <br /> the City on a quarterly basis and thereby may generate substantial potential gambling tax <br /> liability between reporting periods; <br /> WHEREAS, the current ordinance does not specifically include a sanction that <br /> provides that failure to pay the tax subjects the business to forfeiture and loss of its City <br /> business license and the privilege to do business in the City of Everett; <br /> NOW THEREFORE THE CITY OF EVERETT DOES ORDAIN: <br /> Ordinance 1023-84, 1984 as amended by Ordinance 2265-98 § 3 1998; Ordinance <br /> 2264-98 § 1, 1998; Ordinance 1301-86 § 1 (part), 1986 and Chapter 3.36 Everett <br /> Municipal Code are hereby amended to read as follows by amending Section 14 of <br /> Ordinance 1023-84 and EMC 3.36.140: <br /> Ordinance 1023-84, Section 14 and EMC 3.36.140 which reads as follows: <br /> Section 14: Rules and regulations. <br /> The city treasurer shall have the power, and it shall be his duty, from time to time,to <br /> adopt, publish and enforce rules and regulations not inconsistent with this chapter or with <br /> 1 <br />
